How to draft and register a lease between a director and their company?

You rent an office to your company: a registered lease is recommended

Written by Maud WAUTHOZ

Are you the owner of your home and a company director, and have you set up a rental arrangement between yourself and the company?

Drafting a lease

Even though a verbal lease is legal, it is strongly recommended to draw up a written lease and register it to strengthen its tax validity.

💡 A template is available at the end of the article.

Registering the lease

It is strongly recommended to register the lease: you can do so easily via MyRent:

  1. 📄 Upload the signed contract (PDF)

  2. ✍️ Enter the main details (identity, address, rent, duration, type: lease, intended use of the property: mixed)

  3. 💳 Pay the registration duties (0.2%) directly online (minimum: €50)

For an open-ended lease, the 0.2% registration duty is calculated on 3 years of rent (with a minimum of €50).

👉 Example: the rent amounts to €1,800 / year:
€1,800 × 10 = €18,000 → €18,000 x 0.2% = €360
